Dispute Management

PCS provides dispute management services to legal counsel to assist in the resolution process. Claims often arise on a project due to many factors, some of the most common being significant project delays, inadequate documentation, change order costs, poor communication and unrealistic expectations. PCS utilizes its extensive construction management experience to analyze the project management issues involved in a claim to arrive at the cause and effect.

What went wrong? Analyzing the Claim

At PCS, there is no predefined formula for analyses because each project, each situation, is unique. We apply our expertise to gather the facts that tells the project's story and determines the cause and effect.

In order to prepare for a claim, we complete the following:

  • CPM schedule/productivity analysis which includes evaluation of delays, disruptions, acceleration, change conditions, etc.
  • Assist with documentation "mining"
  • Review of daily and monthly reports, correspondence, RFIs and FCNs
  • Entitlement assessment
  • Verify project costs
  • Analyze information

Can litigation be avoided? Alternative Dispute Resolution

With the high costs of litigation, clients may opt for alternative dispute resolution (ADR). Successful ADR calls for different skills, preparation, and presentation methods than those used in courts of law. PCS consultants can provide the analysis and support required to reach a successful outcome.

How can PCS help? Litigating a Claim

PCS strives to resolve a dispute before it progresses to formal litigation. However, if an agreement can not be reached, PCS provides support to the legal team during the dispute reolution process. We are particularly skilled at helping legal counsel communicate highly technical, construction issues to lay audiences (i.e., jury, judge and/or claims board) using demonstrative graphics.

An integral part of the dispute management services at PCS is our ability to create visually persuasive graphic materials, which are created in-house. These support materials are extremely helpful in demonstrating our analyses on the cause and effect of the project. PCS has the capability of creating schedules, PowerPoint presentations, color graphics, tables and charts, 2-D and 3-D graphics, photo editing and enhancements, on-site digital photography, and flash animation all in-house.
